You may not upload, distribute or otherwise publish through the Site any content, information or other material that: (a) violates or infringes upon the copyright, patent, trademark, service mark, trade secret or other proprietary rights of any person; (b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under U.S. or international law; or (c) contains any bugs, viruses, worms, trap doors, Trojan horses or other harmful code or properties. We may assign you a password and account identification to enable you to access and use certain portions of the Site. Each time you use a password or identification, you will be deemed to have been authorized to access and use the Site in accordance with the terms and conditions of this Agreement, and we have no obligation to investigate the authorization or source of any such access or use of the Site.
You will be solely responsible for all access and use of the Site by any person using the password and identification originally assigned to you, whether or not such access and use of the Site is actually authorized by you, including but not limited to all communications and transmissions and all obligations (including but not limited to financial obligations) arising from such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify any unauthorized use of your password or identification information or any other breach or threatened breach of the security of the Site.
While we are happy that more individuals, businesses or organizations who want to customize plush toys find us through the Internet, we refuse to provide customization services for the following situations.
We always encourage and respect human rights, independence and freedom. This means that we do not accept any designs and products that incite violence or encourage crime. These include illegal slave labor, rape, drug use, theft, and any discriminatory designs (personal attacks, attacks on race, religion, national beliefs, and even attacks on personal characteristics such as gender or sexual orientation).
Our company cares deeply about the health and safety of the people who receive our products. We will reject any designs that encourage physical harm, i.e. self-harm, eating disorders, or suicide.
To protect victims and survivors, we do not allow any designs that sexually exploit or endanger others.
We do not encourage the creation of designs that glorify the pain or humiliation of others. Any designs that show nudity, sexual activity, or any pornographic content will be reviewed for appropriate use. For example, if it is used for educational purposes, it may be allowed. All designs of genitalia will be rejected.
We will also refuse to produce your design if it is a knockoff of a well-known brand or a copy of a third party's design drawing.
We believe it is important to take intellectual property rights seriously. Regarding custom designs, we will not produce or resell customer designs to others unless officially authorized. However, our factory owns all rights to paper patterns and we will not share proprietary technical details.
By submitting any ideas, concepts, drawings, or designs ("Submissions") to the Company, the customer declares that they own all rights to the Submissions and that the content is their original work and has not been copied from any other source. If any third party claims intellectual property rights to the custom plush design based on the customer's Submissions, the customer shall indemnify and hold the Company harmless from such claims.
If the customer's submission contains any designs or elements that are owned by a third party or protected by copyright, the customer must provide a valid consent or license agreement from the intellectual property owner to establish the customer's right to use such content.
The customer also understands that the company is independently creating plush designs for hundreds of products and that these designs, either in the past or in the future, may have commonalities or similarities with the customer's submissions, and the customer agrees that the company is not responsible for any such perceived similarities.
We formally guarantee to you that all the materials we use are completely environmentally friendly and safe and meet international children's toy safety testing standards. If your first test fails, our factory will bear the cost of re-testing, and we have never received a claim due to test failure over the years.
However, we cannot bear any re-testing costs if the materials are specified by the customer party and result in unsatisfactory results.
